Can you officiate, and is registration required?
Tennessee sets no registration for a general officiant, and the state’s advisory body for county officials states that the county clerk has neither the authority nor the duty to examine the qualifications of persons seeking to solemnize. Roughly fifteen categories may solemnize, including spiritual leaders having the care of souls, judges, county mayors and county clerks, legislators who have filed notice, and notaries public. Online ordination is the unsettled part: the published code carries language restricting persons who received online ordinations, the litigation over it has produced only partial and party-specific outcomes, and a second challenge failed in 2025. Do not treat it as settled. Confirm with the county clerk, and note that a judge, a county clerk or a Tennessee notary public carries no such question.
Who returns the license, and by when
The officiant endorses the fact and time of the marriage, signs, and returns the license to the county clerk that issued it within three days from the date of the marriage, with the state certificate of marriage in the same window. Failing to return it is a misdemeanor, although it does not invalidate the marriage. Confirm the window with the issuing clerk.
