Can you officiate, and is registration required?
Virginia authorizes officiants by court order rather than by a registry, which surprises officiants who expect a website form. A minister produces proof of ordination and of being in regular communion with their religious society before a circuit court, its judge or its clerk. Anyone else applies to a circuit court clerk, who may issue an order authorizing them to celebrate the rites of marriage and may require a bond. Either order is obtained from one clerk and is valid throughout the Commonwealth, so it is a one-time act, but whether a bond is required and whether the order covers one ceremony or stays open is the clerk’s discretion. Judges, legislators, governors and several other officials need no authorization at all.
Who returns the license, and by when
Every person who officiates at a marriage ceremony certifies to the facts of marriage and files the record in duplicate with the officer who issued the marriage license, within five days after the ceremony. That clerk then forwards records to the State Registrar monthly. Confirm the window with the issuing circuit court clerk.
